Project Description:

The applicant proposes to expand the existing sand & gravel mine operation to include additional 3.28 acres of land to the currently approved 12.0 acre life of mine. The proposed expansion is within an 80.5 acre parcel of land owned by the applicant. The project site is located 2,500 feet west off of County Route 46 (River Road), immediately south of the Town/Village of Theresa line, in the Town of Theresa. Mining is proposed for above the local water table. Excavation will be done by mechanical equipment, standard for sand and gravel mining operations, and for removal of material above the local water table. Mining is proposed to remove approximately 6,000 tons-per-year of sand and gravel over the estimated 5 year operational life of the mine. Material will be stockpiled as unprocessed "run-of-bank", or processed with portable screens and crushers. Maximum processing rates for the screen and crushing operations will not exceed 150 tons-per-hour (TPH). Final reclamation will restore the site to a +/-3 acre uniformly graded and re-vegetated open land. Reclamation will include the replacement of stockpiled topsoil, and re-seeding with an approved USDA SCS seed mixture. The reviewed life-of-mine expansion area is 3.28 (LOM) acres.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit NY0122262 for the surface discharge of 650 gallons per day (gpd) of treated wastewater to Mud Creek Tributary, a class C(TS) water.

The facility batch discharges 650 gpd of treated swimming pool filter backwash twice per week during summer via Outfall 001. The discharge is made to a private pond located within the facility which provides treatment. The pond has an outlet which overflows to the receiving water through a drainage ditch.

DEC proposes to incorporate the following modifications to this permit: Effluent limits and monitoring requirements have been added. Permittee contact information has been updated. Discharge notification requirements have been added. The permit includes updated forms and the latest general conditions. Details of changes are specified in the draft permit and Statement of Basis which may be viewed and printed from the Department web site at: http://www.dec.ny.gov/permits/6054.html.
