Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 026 0738), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). This is a renotice of the Notice of Intent to Modify published in the Environmental Notice Bulletin on 02/11/2009.

The facility stores salt, recycled metal and miscellaneous bulk materials. The facility discharges stormwater via outfall 001, 002, and 003. Treatment consists of a detention pond and oil/water separator at Outfall 001 and oil/water separators at Outfalls 002 and 003. The facility discharges treated stormwater to the Hudson River, a class C water.

The following changes to the permit are proposed: Administrative changes have been made to page 1; Parameters have been added and/or changed for Outfall 001, Short Term Monitoring for parameters has been added; Existing Outfalls 002 and 003 have been added; The following requirements have been added - Mercury Minimization Program, Industry Best Management Practices, Discharge Notification Requirements, and General Conditions; The Recording, Reporting and Additional Monitoring Requirements page has been updated. The permit includes updated forms and the latest general conditions. Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to stabilize 550' of stream bank within Ten Mile Creek, a Class C(TS) waterbody. Approximately 500 CY of Class II Rock riprap is proposed to be installed in a 0.3 acre area, and a 50 year flood bench is proposed to be created.

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
