Negative Declaration

Dutchess County - The Town of Wappinger Planning Board, as lead agency, has determined that the proposed Mid-Hudson Sikh Temple will not have a significant adverse environmental impact. The action involves the construction of a 20,000 square foot Temple and an 1,800 square foot residence for a priest connected to the Temple. The project is located at the northwest corner of Old Hopewell Road and All Angels Hill Road in the Town of Wappinger, New York.

Dutchess County - The Village of Tivoli, as lead agency, has determined that the proposed Tivoli Waterfront Park Project will not have a significant adverse environmental impact. The Village of Tivoli is proposing to develop a waterfront park consistent with its Comprehensive Plan and Local Waterfront Revitalization Plan. The Master Plan for the park includes a parking area, pathways, a pedestrian overpass, fencing and recreational activities such as a dock, gazebo, kayak locker and picnic benches. The site includes about 715 feet of Hudson River shoreline. The project will be constructed in phases, with the first phase consisting of restoration and stabilization of the shoreline. The project is located at the terminus of Diana Road in the Village of Tivoli, New York.

Putnam County - The Town of Southeast Planning Board, as lead agency, has determined that the proposed Ace Endico Site Plan, Conditional Use Permit, Wetland Permit and Lot Line Adjustment will not have a significant adverse environmental impact. Ace Endido, the Applicant, has submitted an application to the Town of Southeast Planning Board for a Site Plan Amendment and Conditional Use Permit to amend the approved site plans for Terravest II Lots 1, 3 and 4 to permit the phased installation of parking on Lots 3 and 4, and a new sidewalk and building entrance on Lot 1. A merger of Lots 3 and 4 is also proposed. In addition, a Town of Southeast wetland permit is also required to connect the proposed improvements to the existing stormwater management system. The project is located at 71, 80 and 81 International Boulevard in the Town of Southeast, New York.

Sullivan County - The Town of Tusten Town Board, as lead agency, has determined that the proposed Adoption of Local Laws to Amend the Zoning and Subdivision Laws will not have a significant adverse environmental impact. The action involves the adoption of amendments to the Town of Tusten's Zoning and Subdivision Laws. Amendments to the Zoning Law include changes to the definitions, campgrounds, conservation subdivision, and multiple-family dwelling sections. Changes to the Subdivision Law include a comprehensive revision which strengthens its effectiveness through improved review procedures and consistency with state statutes. The project is located in Town of Tusten, New York.

Ulster County - The Town Board of Gardiner, as lead agency, has determined that the proposed Local Law Amending Chapter 220 of the Town Code to Regulate Solar Energy Systems will not have a significant adverse environmental impact.

The action involves the proposed amendment of a Local Law which would regulate solar energy systems in the Town of Gardiner. The development of large scale solar energy systems, defined as a ground-mounted solar energy systems that produce energy primarily for the purpose of offsite use, sale or consumption, would be prohibited in the Shawngunk Ridge Protection District (SP-1, SP-2 and SP-3). Large scale solar energy systems would be permitted by special use permit issued by the Town of Gardiner Town Board in all other zoning districts where enumerated area requirements and performance standards can be satisfied. Small scale solar energy systems and solar energy systems designed for a subdivision use would be permitted in all zoning districts subject to the requirements and standards set forth in the local law. Requirements and procedures for decommissioning and removal of large scale solar energy systems and a new provision expressing the Town of Gardiner's intent to require contracts in lieu of taxes for large scale solar energy systems are also included in the local law. Notice of Acceptance of Final SEIS

Dutchess County - The Town of East Fishkill Planning Board, as lead agency, has accepted a Final Supplemental Environmental Impact Statement on the proposed Montage at East Fishkill. The Montage at East Fishkill project is a 128 lot subdivision proposal made to the East Fishkill Planning Board. The applicant, Sharbell Dutchess, Inc. is seeking subdivision approval, a special permit for excavation and fill, and a floodplain development permit to subdivide and develop a 385.5 acre parcel into a "conventional" residential subdivision under the Town of East Fishkill's R-1 Zoning District regulations (subject property tax map number 132800-6556-00-802836). The subject property is located along the south side of NYS Route 52 opposite the intersection of NYS Route 216, in the R-1 zoning district. Sharbell Dutchess Inc., located in Robbinsville, New Jersey, is contract vendee to the property currently owned by the following: Julia Gosen Tucker; Scott Henry Tucker - as successor to interest of "Diana Tucker Trust"; the Estate of Charles F. Tucker, III; and Tucker Realty, LLC (collectively referred to hereinafter as Seller).

The proposed 128 lot conventional subdivision (Proposed Action) would develop the Montage at East Fishkill site using a conventional subdivision design with the development concentrated on 113.57 acres. The conventional lot subdivision includes 122 new single family residential lots, two (2) utility parcels, two (2) open space parcels, a one acre existing single-family lot (which will remain with the Tucker Family Trust) and a 44.02 acre parcel (which will also remain with the Seller) for a total of 128 lots. Out of the 113.57 acres of proposed development, 73.44 acres encroaches within United States Army Corps of Engineer (US ACE) and New York State Department of Environmental Conservation (NYS DEC) regulated wetlands and adjacent buffer areas. The Proposed Action would also require the construction of 13,461 lineal feet of roadway and three bridge crossings. In addition, a cluster subdivision layout (Preferred Alternative) has been proposed as an alternative to the conventional lot layout. The conventional lot layout would result in more impervious area, more site disturbance, more fill in the wetland area and preserve less open space and buffers between the residential lots and the environmentally sensitive areas than the Preferred Alternative Cluster Subdivision. Therefore, the Applicant is proposing the use of a cluster subdivision design as the Preferred Alternative.

The project is located along the south side of NYS Route 52 opposite the intersection of NYS Route 216, in the R-1 zoning district in the Town of East Fishkill, New York.
