Project Description:

The Department has made a tentative decision to approve the application for modification of a permit for an existing discharge of treated wastewater into the East River (Class I) from the applicant's facility located at the Northwest end of Roosevelt Island. In support of the City Tunnel #3 Stage 2 Activation in Queens and Brooklyn, the applicant proposes modify the discharge rate to a maximum of 80 million gallons per day for dewatering activities during the tunnel emptying and activation. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Applicant proposes to construct a new 8-foot by 6-foot stormwater outfall, located west of the intersection of 20th Avenue and 119th Street in the College Place neighborhood of Queens. The outfall would extend approximately 150 feet west of the western terminus of 20th Avenue, and be equipped with a tide gate to prevent backflow as well as a stone slope splash pad to attenuate flow velocity and prevent scour prior to release of stormwater into Flushing Bay. Permanent impacts to NYSDEC-regulated tidal wetlands will be mitigated through 8,622 total square feet of Spartina alterniflora plantings (3,765 square feet at the outfall site, 4,857 square feet at Macneil Park in Queens), and removal of the derelict vessel west of the intersection of 20th Avenue and 119th Street. In addition, the stormwater outfall will allow a combined sewer outfall at this location to be eliminated.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYC Dept of Environmental Protection

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
