Project Description:

The applicant is proposing the construction and operation of a National Cemetery to provide eligible Veterans in the Western New York Region with reasonable access to burial needs for at least the next 10 years. As proposed, approximately 79 acres of the 192 acre site will be developed to include internment sites, committal shelters, roads, buildings, landscaping, signage and supporting infrastructure. The project will result in the clearing of 0.74 acres of federally regulated wetland. To offset these impacts the applicant will be purchasing up to 1.0 wetland mitigation credits in the Niagara Service Area. A site specific stormwater pollution prevention plan has been prepared. The proposed action is subject to the National Environmental Policy Act (NEPA). Accordingly, a Site Specific Assessment (SEA) was prepared and a Findings of No Significant Impact (FONSI), including a signed cultural resources Memorandum of Understanding, was finalized on February 10, 2017.

State Environmental Quality Review (SEQR) Determination:

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The activity is being reviewed in accordance with federal historic preservation laws (Section 106 of NHPA) and the project area of potential impact is substantially the same.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has made a tentative determination to issue a freshwater wetland permit to authorize the Town of Geneva to place water main, by open trench method, within the regulated adjacent area of freshwater wetland GV-5 along Pre-emption Road in the Town of Geneva. This watermain is part of a larger project including water main in the towns of Junius and Waterloo. The Department seeks comments prior to making a final decision.

Project Description:

Applicant proposes to stabilize bank by installing an approximately 107-foot breakwall on Canandaigua Lake that is above mean high water level (MHWL) with toe stone protection in front of the wall that extends below MHWL, requiring an Article 15 Protection of Waters permit. The angular toe stone will be placed at the base of the wall to prevent scour and provide habitat.

No further review in accordance with SHPA is required.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
