The applicant, the NYS Department of Environmental Conservation, proposes excavation of approximately 0.34 acre of wetland in Glenmere Lake as part of a total remediation area of approximately 2.0 acres for the removal of metal contaminants, primarily lead and arsenic. Approximately 165 cubic yards of wetlands sediment and approximately 160 cubic yards of lake sediment will be removed from the site and replaced with clean fill. As implementation of an inactive hazard waste site remediation under the State Superfund Program, this action is specifically exempted from all state permits pursuant to 6 NYCRR 375-1.12(a). The County of Orange is the sole owner of the property.

Project Description:

The project sponsor proposes the realignment and improvements to Chalet Road (the "Chalet Road Improvements") to allow for the increase in traffic expected upon the completion of the Town-approved Waterpark and Resort Hotel at Adelaar (the "Waterpark").

Approximately 7,000 linear feet of Chalet Road will be reconstructed and widened from 15 or 18 feet to a uniform 22 feet. The Chalet Road bridge and a golf cart bridge crossing Kiamesha Creek will also be replaced. The "Chalet Road Improvements" activities will disturb approximately 32,800 square feet the NYS DEC regulated 100 foot adjacent area of Freshwater Wetland MO-56 (Class II) for the purpose of removing and replacing existing pavement and associated grading along the roadside. In addition, "Chalet Road Improvements" will permanently disturb 220 square feet of federally regulated wetlands requiring the NYS DEC to issue Section 401 Water Quality Certification.

Disturbance to the regulated wetlands have been minimized by incorporating headwalls to reduce the amount of grading necessary along the roadside. No impacts to any State-regulated wetlands or watercourses are currenlty proposed for the construction of the "Waterpark" and its associated infrastructure (i.e. parking areas, stormwater structures, etc.).

The "Chalet Road Improvements" are associated with the overall comprehensive development plan for the site, formerly known as EPT Concord Resort, that was originally supported by an Environmental Impact Statement that was accepted as final on January 2, 2013, by the Town of Thompson Town Board, serving as SEQR Lead Agency.

Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

The applicant proposes to disturb NYS Freshwater Wetland H-3, Class 3, by applying herbicide (Rodeo - active ingredient Glyphosate) to eradicate a 2-acre patch of Mile-a-Minute vine (Persicaria perfoliata) from 560 Swartekill Road, in the Town of Esopus, Ulster County. Application will be performed using low volume treatment via a backpack sprayer, and surfactant LI-700 will be used to enhance visual confirmation of application to the target species. Treatment of Rodeo will occur at least twice during the summer months. This effort is part of a larger collaborate effort to contain this plant within the state designated Lower Hudson Partnership for Regional Invasive Species Management (LH PRISM).

Laurel Ridge Development previously received authorization to construct 46 multi-family housing units, 4 of which were located within a DEC-regulated wetland adjacent area, as part of a multi-phased development known as Oakridge Gardens. To date, 19 units have been constructed, 17 units are currently under construction, and the remaining 10 units have not yet been constructed. A DEC Freshwater Wetland permit is required for the construction of portions of 2 of the 10 units, which are located within the adjacent area of freshwater wetland D-11, class 1, and requires approximately 2,880 square feet of disturbance. Approximately 2.4 acres on site will be planted with native vegetation, by hand, and includes the removal of invasive species.
