Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit NY0069604.

The Metro-North Railroad Port Jervis Yard is a limited use layover facility. Wastewater is generated as stormwater runoff via outfall 001 (stormwater runoff) and outfall 002 (stormwater runoff from Layover area of yard). There are no under or above ground fueling tanks onsite.

DEC proposes to incorporate the following modifications to this permit: The discharge class is being changed from 01 (significant minor) to 04 (non-significant). Action level sampling requirements for benzene, toluene and xylene were removed. The permit includes updated forms and the latest general conditions. Details of changes are specified in the draft permit and statement of basis which may be viewed and printed from the Department web site at: http://www.dec.ny.gov/permits/6054.html.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has made a tentative determination to approve this application for re-issuance and modification of a SPDES permit (SPDES #NY-0280968) for a surface discharge from the former Tamarack Lodge (Outfall No. 001) with an average monthly flow of 70,000 gallons per day (gpd) of treated sanitary wastewater to Braden Brook, Class B(t). The applicant seeks re-issuance of the permit as the previously issued SPDES has lapsed. The existing wastewater treatment plant will be upgraded to treat sanitary sewage generated by the development. The project includes redevelopment of approximately 50 acres of the former Tamarack Lodge site into a 93-unit single family residential development with day camp, two swimming pools, various recreational facilities, internal roadways, and stormwater management facilities on approximately 217 acres. Three (3) existing on-site wells will provide approximately 70,000 gpd of potable water to the development. The project is located on NYS Route 52 near the intersection with Tamarack Road in the Town of Wawarsing. A draft permit is available for inspection and comment at the regional office.

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
