Project Description:

The applicant intends to renew their current mining permit for an additional 5 year period, and to modify the permit to include 0.8 acre of land consisting of the common property line setback area with the Gernatt Borer Freedom Plant property under permit to be mined. There will be no change to the current mining methods already in place.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jun 16, 2017.

Project Description:

Alternative Resources Management Inc. (ARMI) currently operates a permitted solid waste management facility at 1501 College Avenue in the City of Niagara Falls. The facility is currently permitted to accept construction and demolition (C&D) debris and process it. ARMI is proposing to renew the permit as well as modify the permit to accept up to 500 tons per day of materials approved for use as refuse-derived fuel (RD) and tire-derived fuel (TDF). Materials to be accepted include clean C&D wood, cellulose, raggertail (consisting of plastic trimmings, tape, labels and baling wire found in baled post-consumer paper waste), waste tires. These materials will be processed (reduced in size) and blended to the specifications of customers. Metals removed from the materials will be sold.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
