Project Description:

DEC received a request from the permittee for a modification to the existing State Pollutant Discharge Elimination System (SPDES) permit issued for the facility. DEC has made a tentative determination to issue the modification authorizing the discharge of up to 3,000 gallons per day of treated effluent to Henderson Harbor, a Lake Ontario embayment. Treatment is proposed to consist of a grease trap, primary settling, rotating biological contactors, cloth media filter, and disinfection. The permittee requested a review of the sample frequency and sample type for specific parameters. These changes were determined to be appropriate for the type and nature of the discharge. The following is a summary of the proposed changes in the draft permit as compared to the currently effective permit, the details of which are specified in the draft permit:

  • The sample type for BOD5 and Suspended Solids has been changed from 24-hour composites to 6-hour composites.
  • The sample frequency for Fecal Coliform has been changed from daily to monthly.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to develop and operate a 16.35 acre sand mine within a 26.2 acre parcel off County Route 44. The project site is on property owned by the applicant and lies 500 feet southwest of County Route 44 and approximately 1.5 miles southeasterly the intersection of County Routes 44 and 14 (Chamberlain Corners). The mine is intended to operate as a traditional surface extraction of the Adams Sand, Adams Loamy sand, Dexford loamy fine sand, Dexford mucky loamy sand and the Hogansburg and Grenville soil types on the site. Mining is proposed to take place below the local water table to a depth of 6 to 15 feet with the deepest portion being up to 30 feet deep. Excavation will be done by excavator and front end loader, standard for sand mining operations. Minimal processing of the sand is anticipated with low volume screening plant being used. Large cobbles and boulders will be buried on site. Mining is proposed to remove approximately 416,000 cubic yards of sand over an estimated 20 year operational life of the mine. Final reclamation will restore the site to an open water pond for recreational purposes. Sand exposures will be graded and soils will be spread and then seeded with a perennial grass seed mixture. The reviewed life-of-mine area is 16.35 (LOM) acres.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
