Project Description:

The applicant proposes a new 3.6 acre life of mine sand mine on an 112 acre parcel owned by William Sabin. The maximum depth of excavation is proposed to be 12' and will not enter groundwater. The proposed operating hours is 7:00 am to 3:30 pm, Monday- Friday with no mining occurring on legal holidays. The access road will be within 500' of a dwelling. No onsite processing is proposed. Site would be reclaimed to grassland upon termination of mining. The proposed mine is located off NYS Route 95 in the Town of Moira.

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The NYS DEC has prepared a draft permit and has made a preliminary determination to re-issue the applicant's State Pollutant Discharge Elimination System (SPDES) permit pursuant to Article 17 of the Environmental Conservation Law, for the continued subsurface discharge of domestic sanitary waste through an existing system consisting of two subsurface outfalls with a combined design flow of approximately 50,000 gallons per day. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based upon information currently available to the DEC. As a tentative determination, the DEC seeks comments on the proposed action. This tentative determination does not signify DEC approval or endorsement of the action for which permit coverage is sought.

Applicant proposes to modify their current Mind Land use Plan/Mining Permit to expand the current 14.1 acre Life of Mine an additional 8 acres to include the excavation of a 6 acre pond to be incorporated into the final reclamation for this sand and gravel mine. Continued processing of materials (crushing and screening) on site is anticipated. This site is located along St. Rt. 29 approx. 1000 feet north of Brophy Ln. in in the Town of Greenwich.
