Project Description:

The Department has made a tentative determination to issue a modification of the SPDES permit for the site of the former Russel Generating Station. The modified permit would reflect the station demolition and non-operational status of the site, and include the following changes: addition of Outfall 005 for stormwater runoff from the cap of the former coal pile, monitoring requirements for Outfall 005, elimination of monitoring requirements from stormwater-only Outfalls (001, 003, 004), and change of discharge class from 03 ("EPA Major") to 04 ("Non Significant Industrial Minor"). Discharge of stormwater from all outfalls would be to Slater Creek at three locations between Ling Road and Edgemere Drive. A draft SPDES permit and a "Statement of Basis" has been prepared and are available for review. Those wishing to submit comments should refer to the application number above, and SPDES No. NY-0000612.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Greece Town Board

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The activity is being reviewed in accordance with federal historic preservation laws (Section 106 of NHPA) and the project area of potential impact is substantially the same.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Town of Barre proposes to construct the Water District No. 8 to serve residents along several roads in the Town of Barre from the Village of Albion Water Treatment Plant. The project includes horizontal directional drill crossing of the regulated Class A tributary Otter Creek (of the Albion Reservoir) along Maple Street in two locations, and one location at Kams Road, and crossing regulated Freshwater Wetland KN-12 along Eagle Harbor Road, as well as federal wetlands along these two roads by open trench method. The Department seeks comments prior to making a final decision.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 1,100 gallons per minute of water from Windward Lake for the purpose of golf course irrigation. The facility has been in operation in its current configuration since 1997.

The Department has determined that the facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
