Project is Located:

Project Description:

Located off of Sunset Blvd within the Town of Colonie, the proposed project will place approximately 400 CY (25' x 170' x 2.5') of clean fill over an existing shallow buried gas line within the previously disturbed Right-of-Way. The adjacent area of NYSDEC regulated freshwater wetland A-10 will be permanently impacted by 400 CY of clean fill; during stockpiling of the material, temporary impacts will be limited to approximately 135' x 15' in the adjacent area. An unmapped, unnamed Class C stream will be temporarily impacted by timber matting to allow access to the site.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
