Project Description:

The Department has made a tentative determination to approve an Air State Facility Permit application renewal for an existing facility. The Hunts Point Wastewater Treatment Plant (WWTP) is a publicly owned secondary wastewater treatment plant capable of providing treatment for 200 million gallons of primarily residential wastewater per day in dry weather. The application includes updated equipment and processes: existing sludge degritting (SDT) process, and a non-exempt chemical storage (CMS) process. The application removes: four existing boilers and related process (BL0); two Easco 350BHP interim boilers and related processes (SBG & SBO); one Eastmond 400BHP boiler (never installed) and related processes (RBI & RBO).

The facility NOx emissions are capped at 24.9 T/yr; VOC emissions are capped at 24.9 T/yr; and Total HAPs emissions are capped at 24.9 T/yr. The annual operating hours for each emergency generator is limited to 500 hours. The owner or operator of the facility shall maintain separate records of the amount of fuel combusted in each engine generator. Records demonstrating compliance with these caps will be kept in accordance with the permit special conditions. The facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility (ASF) permit for an existing ASF permitted medical facility. The facility is currently permitted to operate three 11.20 mmBtu/hr No.6 fuel oil boilers, one emergency diesel generator, and three underground fuel oil storage tanks under ASF permit #2-6101-00310/00004. The facility is replacing three existing boilers with two 10.46 mmBtu/hr Cleaver Brooks CBI-200-250-125 dual fuel boilers firing natural gas or No.2 fuel oil. The No.6 oil tank will be converted to No.2. The facility also operates two exempt 1.999 mmBtu/hr Raypak/WH7-2003 natural gas fired hot water heaters, and one 2.501 mmBtu/hr Raypak/H7-2503 natural gas fired water boiler.

The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department has made a tentative determination to approve an application for a new permit for a proposed withdrawal and discharge of up to 800,000 gallons per day of treated groundwater into Flushing Bay (Class I) via the Port Authority's existing SPDES Permit #NY0008133 Outfall #13, from a treatment system at the applicant's project site located at LaGuardia Airport where the applicant will temporarily dewater to facilitate construction of a new Central Terminal Building.

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
