Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0022543) for the surface discharge of 7.68 mgd of treated wastewater to Big Sister Creek, a class B(T) water via Outfalls 001, 002 (ORF), and 003 (SUM/Combined).

Treatment at the facility consists of advanced secondary treatment followed by tertiary filtration, UV disinfection, clarification and disinfection.

DEC proposes to incorporate the following modifications to this permit: Limits for parameters have been adjusted. Winter Ammonia Limit has been recalculated. A temperature action level has been added. Whole Effluent Toxicity testing has been added. Monitoring for Enterococci during the summer has been added. Annual Priority Pollutant Scans have been added. A mercury limit and a Pollutant Minimization Program has been added. Outfall 003 has been added to limit the combined effluent from Outfalls 001 and 002. Locations of Outfalls 001 and 002 have been updated. Capacity, Management, Operation, and Maintenance (CMOM) program has been added. Requirements to develop a Wet Weather Operating Plan (WWOP) has been added. A Schedule of Compliance for the CMOM and WWOP has been added.

The permit includes updated forms and the latest general conditions. Details of changes are specified in the draft permit and fact sheet.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has made a tentative determination to approve a permit modification to the applicant's existing permit. Frontier Fibers, LLC currently operates a solid waste management facility at 4870 Packard Road that processes paper mill residue into animal bedding. Frontier Fibers is proposing to modify the existing permit to accept additional materials including wood, raggertail (consisting of plastic trimmings, tape, labels and baling wire found in baled post-consumer paper waste), cellulose, and waste tires. These materials will be processed and blended to the specifications of the customer for use as an alternative fuel. No materials will be combusted at the Frontier Fibers facility.

The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought.
