Project Description:

The project involves the implementation of natural stream design measures within Big Brook, a protected C(T) stream in the Town of Marshall, Oneida County. A total of 300 cubic yards of fill will be placed below the mean high water mark of Big Brook. The installation of 135 linear feet of toe wood will result in 200 cubic yards of fill, while the placement of a rock cross vane structure for stream bed grade control will result in 100 cubic yards of fill. Portions of Big Brook at the project location will be shaped to the proper stream dimensions identified through survey of reference reaches and the use of the USGS's Streamstats program.

State Environmental Quality Review (SEQR) Determination:

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The New York State Department of Environmental Conservation has made a tentative determination to reissue a State Pollutant Elimination System (SPDES) permit under Article 17 of the Environmental Conservation Law. The approved application is for the discharge of 7,500 gallons per day of treated sanitary wastewater to Deans Creek Tributary, a Class C waterbody, from the applicant's facility located in the T-Vernon, Oneida County, NY. The proposed changes include updated facility contact information and permit pages revised to reflect current NYSDEC format, nomenclature and general conditions. There are no other changes.
