Project Description:

The Department has received an application from CP Holdings Group, Inc. for the renewal of the Title V Facility permit to authorize operations at its Commodore Technology LLC facility, which manufactures polystyrene foam for food packaging. The site is located on Maple Avenue in the Village of Bloomfield, Ontario County. In addition to renewing the permit the following updates will be made: addition of two (2) foam extruders for a total of six (6), addition of four (4) material storage silos for a total of sixteen (16) and addition of Emission Unit U00003, paint booth and surface coating operations.

The plant meets the definition of a Major Source in 6 NYCRR Part 201‑2.1(b)(21) and is subject to Part 201-6 Title V regulations due to emissions of volatile organic compounds (VOC) in excess of 50 tons per year. The Department has prepared a Draft Permit and has made a tentative determination to issue a Title V Facility Permit based on the application.

CP Holdings Group also seeks a continuance of its variance to avoid emission control requirements specified in 6 NYCRR Part 212.3 Reasonably Available Control Technology (RACT) for VOC emissions. The variance proposed would allow operation of 4 foam extruders, thermoforming operations, and foam roll storage without emission controls. The variance is based on low concentrations of slowly released VOC resulting in costs for emission control significantly in excess of the Department's guideline level per ton of emissions controlled. The Department will require re-evaluation of the RACT variance if potential VOC emissions from all sources increase from the current 122.7 tons per year to reach 150 tons per year.

Foam reclamation operations, with higher VOC release rates, will continue to be vented through a thermal oxidizer for VOC emission control.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Akeley Manor LLC proposes to continue an existing discharge of 5,380 gallons per day of treated sanitary wastewater to a tributary of Sandy Creek, a class C waterbody, from an intermediate sand filter/mound treatment system located at 17179 Fourth Section Rd, Clarendon, Orleans County.

The Department has made a tentative determination to issue this State Pollutant Discharge Elimination System (SPDES) permit. This tentative determination indicates that the facility's SPDES discharge is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. This tentative determination does not signify department approval of or endorsement for the proposed project. In comments, refer to this application's ID number shown above and SPDES # NY 0271969.

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
