Notice of Legislative Public Hearing

The New York State Department of Environmental Conservation (NYS DEC) proposes to amend the regulations that implement the State Environmental Quality Review Act (SEQR; codified at Part 617 of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York). NYS DEC has previously provided notice of the proposed regulatory amendments and completion of a draft generic environmental impact statement for the proposed rules in the February 8, 2017 editions of both the New York State Register and the Environmental Notice Bulletin. That notice also indicated that NYS DEC would hold a legislative public hearing on the proposed amendments on March 31, 2017, commencing at 1:00 p.m., at NYS DEC Central Office, Room 129, 625 Broadway, Albany, New York.

NYS DEC hereby gives notice of the following additional legislative public hearings and public information sessions on the proposed amendments:

Date: April 13, 2017
Time: 6:00 p.m.
Location: Suffolk County Water Authority

Hauppauge New York; and

Date: April 18, 2017
Time: 6:00 p.m.
Location: RIT Inn and Conference Center
5257 West Henrietta Road
Rochester, New York.

NYS DEC will also conduct public information meetings immediately prior to the start of each of these additional hearings. The public information meetings will be from 3:30 p.m. to 5:00 p.m. at the same location.

The purpose of the scheduled public hearings is to receive unsworn statements from the public on the proposed SEQR amendments before an Administrative Law Judge (ALJ). The purpose of the public information sessions will be for DEC staff to answer questions regarding the amendments.

All persons who are interested in the proposed amendments are invited to attend the hearings and to submit oral or written comments on the proposal. Lengthy statements should be in writing and summarized for oral presentation. Equal weight will be given to both oral and written statements. The ALJ may limit the time available for oral comments to ensure that all persons have an opportunity to be heard. The hearing facility is reasonably accessible to the mobility impaired. Translator services shall be made available, at no charge, upon written request to the Office of Hearings and Mediation Services (OHMS). All requests for translator services must be made to OMHS, 625 Broadway, First Floor, Albany, NY 12233-1550. Phone: (518) 402-9003. Any request must be received no later than 4:00 p.m. at least ten days prior to the hearing date. Interpreter services shall be made available to deaf persons, at no charge, upon written request to the OHMS at the address listed above at least ten days prior to the hearing date.

For those unable to attend the legislative public hearing written comments may be submitted by no later than the close of business on May 19, 2017 to the contact person identified below. Comments may be submitted by e-mail in PDF or MS Word format.

Extension of Public Comment Period

Extension of Public Comment Period for the Proposed March 2017 Technical Amendment to A Total Maximum Daily Load Analysis to Achieve Water Quality Standards for Dissolved Oxygen in Long Island Sound, December 2000.

The New York State Department of Environmental Conservation (NYS DEC) is extending the comment period for the proposed March 2017 Technical Amendment to "A Total Maximum Daily Load Analysis to Achieve Water Quality Standards for Dissolved Oxygen in Long Island Sound, December 2000 until April 28, 2017". The NYS DEC published notification of this technical amendment in the March 15, 2017 edition of the Environmental Notice Bulletin (ENB). The extension of the comment period has been granted based on stakeholder requests.

Draft Amendment No. 1 to the FFY 2017 CWSRF Intended Use Plan

Addition of Green Innovation Grant Program Projects to the Clean Water State Revolving Fund Annual Project Priority List, Smart Growth Review, Modification of Sources and Uses, Engineering Planning Grant Program Funding, and Adjustment of Financing Application Date

The New York State Environmental Facilities Corporation (NYS EFC) and the New York State Department of Environmental Conservation (NYS DEC) announce that the Federal Fiscal Year (FFY) 2017 Intended Use Plan (IUP) for the Clean Water State Revolving Fund (CWSRF), dated October 2016, is being amended.

EFC is seeking comment on the 2017 CWSRF IUP Draft Amendment No. 1.

This Draft Amendment to the Clean Water State Revolving Fund (CWSRF) Intended Use Plan (IUP) for Federal Fiscal Year (FFY) 2017 includes addresses five topics:

  1. Green Innovation Grant Program (GIGP) Round 8 projects,
  2. Smart Growth review of GIGP Round 8 projects,
  3. Modification of Sources and Uses,
  4. Engineering Planning Grant (EPG) program funding, and
  5. Adjustment of the financing application date.

The Draft Amendment No. 1 will be available on the NYS EFC website at: www.efc.ny.gov.

Written comments on Amendment No. 1 to the CWSRF IUP will be accepted by mail, e-mail, or fax until close of business, April 28, 2017.

Revision of Draft Amendment No. 3 to the Drinking Water State Revolving Fund (DWSRF) Federal Fiscal Year (FFY) 2017 Intended Use Plan (IUP)

FFY 2017 DWSRF Intended Use Plan Amendments:

The New York State Department of Health (NYS DOH) is revising Draft Amendment No. 3 and is extending the public comment period from April 12, 2017 to April 26, 2017.

The original Draft Amendment No. 3 was published on March 29, 2017 and included the following project: DWSRF#18149 Ocean Beach (V), Suffolk County - The project cost as listed in the DWSRF Intended Use Plan (IUP) is increased by $1,350,000. This increase is necessitated by actual construction contract bids that were received for the project.

The revised Draft Amendment No. 3 adds the following project: DWSRF#18185 Phoenix (V), Oswego County - The project cost as listed in the DWSRF Intended Use Plan (IUP) is increased by $400,000. This increase is necessitated by actual construction contract bids as well other updated project cost information that was received. This project amendment supersedes Amendment No. 2 which was finalized on February 16, 2017.

NYS DOH has determined that the amendments are necessary, reasonable, and in the interest of protecting public health. The amendments will not adversely affect any project on the IUP Project Annual List above the subsidized funding line. Except as noted above, there are no other changes to the IUP as a result of this Amendment No. 3 of the FFY 2017 IUP.

NYS DOH will accept comments on Amendment No. 3 to the FFY 2017 DWSRF IUP by mail, fax or email until 5:00 p.m. EST on Wednesday April 26, 2017.
