Project Description:

The Department has made a tentative determination to approve an application for a renewal of an Air State Facility Permit for an existing permitted apartment complex. The facility operates a combustion installation consisting of two boilers with a heat input capacity of 141.7 mmBtu/hr and 130 mmBtu/hr, and four emergency diesel generators: 450 kW, 450 kW, 2000 kW and 560 kW. Each source emits through the individual stack. The annual facility nitrogen oxides (NOx) emissions are limited to 24.9 tons/yr.

The facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

Applicant proposes to operate a temporary dewatering system to facilitate the construction of elevator pits and site-wide cellar slab for a new multi-story, mixed-use building at 137 Beach 116th Street in Rockaway Park, Queens with a maximum withdrawal of 1,224,000 gallons per day. Pumped groundwater will be treated and directed to an existing NYCDEP 24" storm sewer along Beach 116th Street which will discharge to Jamaica Bay via a NYCDEP outfall located at the intersection of Beach 118th Street and Beach Channel Drive, adjacent to Beach Channel Park.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
