Negative Declaration

Genesee County - The Town of Byron Town Board, as lead agency, has determined that the proposed Town of Byron - Water District No. 8 will not have a significant adverse environmental impact. The action involves the development of plans for public water supply improvements to Water District No. 8. The Town Board is applying for funding assistance from the USDA Rural Development to undertake the project. As currently proposed, Water District No. 8 involves the installation of approximately 50,600 linear feet of 8 inch and 10 inch waterlines along portions of Cockram Road, Tripp Road, Ivison Road, Gillette Road, Freeman Road, Coward Road, Lyman Road, and Beaver Meadow Road in the Town of Byron, New York. Depending on the budget, an additional approximately 3,200 linear feet of waterline may be installed along the portion of Ivison Road between Gillette Road and Freeman Road as part of future efforts to provide reliable water supply infrastructure and, as such, this segment has been included in the project area undergoing environmental review. Activities include the installation of watermain, fire hydrants, valves, flushing units, watermain connections, residential hook-ups, road crossings, borings of NYS Route 262 (County Road 13/Townline Road) and railroad tracks, excavation and bedding materials and surface restoration. The purpose of the project is to address serious health and safety problems and ensure that residents of this area have a reliable supply of good quality water and fire protection.

Livingston County - The Town of Avon Planning Board, as lead agency, has determined that the proposed Quicklee's Travel Plaza - Amended Site Plan will not have a significant adverse environmental impact. The action involves the redevelopment of the existing commercial operation (Quicklee's Convenience Store and Fueling Station) which includes the construction of a new Ouicklee's Convenience Store with Fueling Station, a new Travel Plaza with Fueling Station (Diesel), Parking areas to accommodate 140 vehicles, a Maintenance Building, and the existing car wash to remain all located within the Planned Development District (PDD) zoning district.

The amended site plan now includes (15) 22 foot tall light poles and (1) 44 foot tall light pole within the proposed truck parking lot of the Quicklees site.

The project is located at 2781 Lakeville Road in the Town of Avon, New York.

Schuyler County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Wixson Sand and Gravel Mine will not have a significant adverse environmental impact. The action involves a Mined Land Reclamation Permit application for a new 27.8 acre sand and gravel mine received by NYS DEC. The proposed hours of operation are 7:00 a.m. to 5:00 p.m. Monday - Friday. Extraction of minerals would take place by using a front end loader and excavator. On-site screening and crushing of minerals is proposed. The project is located on the south side of Cotton-Hanlon Road in the Town of Montour, New York, approximately 0.4 miles west of the intersection with State Route 224.
