Project Description:

The applicant proposes to reopen an inactive mine site within the same previously approved life-of-mine (LOM) boundary, where the previous permit expired. The proposal is for a 45-acre LOM over a 25-year period, with 19 acres to be affected and 5 acres to be reclaimed within the upcoming 5-year permit term. The mining will include onsite processing by screening and crushing. Two existing access roads will be used off of Birmbaugh Road, the main entrance, along with another haul road to be used for entrance only. Hours of operation Monday-Friday, 7:00 AM-4:30 PM and Saturday 7:00-12:00 PM (no processing on Sunday) with an extra hour before and after these hours for site safety and equipment maintenance only. The mine will be reclaimed to grassland with a 2H:1V slope. The mine is located on the south side of Birmbaughn Rd, .5 miles west of the intersection of Routes 9N & 22.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Apr 14, 2017.

Project Description:

Replacement of an existing railroad tie seawall along the shore of Glen Lake with a natural rock stabilized slope. Up to 200 feet of the total 490 foot long existing wall will be removed and the exposed bank stabilized with fabric, natural rock and vegetation where appropriate.
