Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility (ASF) permit for an existing permitted Air Title V (ATV) residential apartment complex. The Title V permit (DEC ID# 2-6203-00047/00004) will be relinquished and discontinued upon ASF issuance. The facility is a housing complex consisting of four towers of apartments, with a central heating and air conditioning plant that provides heat and hot water for 656 residential apartments. Four identical boilers (27.675 MMBTU/hr each) fire primarily natural gas and ultra low-sulfur distillate No.2 fuel oil as a back-up during gas curtailment and the flue gases are discharged through one common stack. These four boilers provide low pressure steam heat, steam for hot water, and for cooling the refrigerant (by absorbing heat) for air conditioning. The facility operates other sources which are considered exempt from permitting in accordance with 6 NYCRR 201-3.2(c), including one emergency diesel generator (<500 hrs/yr), three horizontal petroleum storage tanks (20,000 gallons each) and thirty-eight laundry dryers.

With this application, the facility proposes to downgrade from an ATV to an ASF by capping the facility wide total nitrogen oxides (NOx) emissions below 25 tons/yr. The facility's NOx emissions are limited to 24.9 tons/yr. The draft permit contains sulfur dioxide provisions and is subject to 6 NYCRR 225-1.2, for fuel composition, sampling, analysis and use - sulfur limitations, which restricts the sulfur content of distillate fuel oil utilized throughout the facility to 0.0015 % by weight or less.

The facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Comments on this project must be submitted in writing to the Contact Person no later than Apr 14, 2017.
