Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 200 gallons per minute of water from an on-site well for golf course irrigation. The facility has been in operation since at least 2011. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The Department has prepared a draft permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and made a tentative determination to issue a New Air State Facility Permit for the Northern Bituminous Concrete Mix, LLC facility located at 6900 Van Buren Road, Van Buren, NY. The facility manufactures hot mix asphalt products related to the transportation industry. The bituminous concrete will be prepared in a counterflow drum mix plant, with a practical operating capacity of 350 tons per hour. In this type of plant, the material flow in the drum is heated by a natural gas or propane burner. The liquid asphalt cement is then mixed behind the burner flame zone so as to remove the materials from direct contact with hot exhaust gases. Mixing and heating of the material is completed within the counterflow drum and the exhaust passes through a baghouse to prevent particulates from entering the surrounding air. Once completed, the hot mix is conveyed to a hot storage silo or is dropped directly into a truck and hauled to a job site.

The draft permit includes facility‑wide federally enforceable emission caps to keep total facility emissions of volatile organic compounds and hazardous air pollutants below Title V major source thresholds. Once the facility is operational, an ambient impact assessment must be completed by the facility. The assessment must be based on Department approved modeling results and calculations using emission factors based on AP-42 or emission factors based on the results of a valid, Department approved stack test. The stack test must use a Department approved protocol. The protocol must be submitted to the Department at least 30 days before the test is conducted. Emissions and facility operating parameters are required to be determined on an as needed basis, by the Department, and reported to the Department in the facility's annual capping certification report.

The applicant proposes to modify and renew an existing Mined Land Reclamation Permit with the addition of 4.5 acres to the currently approved 4.25 acre life of mine, bringing the total life of mine to 8.75 acres. Bank run gravel will be excavated using a payloader, excavator, and bulldozer, and the mine floor will remain a minimum of five feet above the seasonal high water table.
