Negative Declaration

Dutchess County - The Town of Hyde Park Planning Board, as lead agency, has determined that the proposed Enclave at Hyde Park will not have a significant adverse environmental impact. The project site is a 116.74 acre property with 74 existing lots previously approved in 2006 for single-family development known as "The Meadows". The 2006 approval was preceded by extensive review via the Town's zoning, subdivision regulations and other pertinent provisions of the H.P. Code as well as approvals and permitting by Dutchess County and New York State agencies. The original Meadows project was the subject of an intensive review under the New York State Environmental Quality Review Act (NYS SEQRA) via an Environmental Impact Statement (EIS) process culminating in a SEQRA Findings to approve the project. Construction of 10 homes and the following improvements began in 2007: two (2) town roads; water supply and sewer treatment buildings and facilities; and associated collection and distribution systems; and a stormwater management system and related ponds and storm management practices (SMPs) were installed.

The proposed action, called "The Enclave", involves a new subdivision of the same site to create 25 residential lots for 2-family residential development or 50 dwelling units (2 or 3 bedrooms/unit). The constructed infrastructure (roads; water and sewer buildings and facilities as well as distribution and collection systems) will be used to focus development on previously disturbed land and minimize further disturbance on other portions of the site. Of the 10 existing residential structures, 9 would be demolished; and 1 will become a Membership Club for residents. Given the reduction from 74 to 25 lots and 74 to 50 homes, the resulting impervious coverage would be 6.08 acres as compared to the previously proposed coverage of 9.23 acres. The action proposes to keep about 110 + acres as either open space in its natural state; or lawn and landscaped areas, including a 25 acre lot to be developed as a solar farm. Once proposed, the 25 acre solar farm will be the subject of a separate SEQRA review.

The project is located on Cream Street at Long Branch Road in the Town of Hyde Park, New York.

Sullivan County - The Town of Delaware Planning Board, as lead agency, has determined that the proposed Delaware River Solar, LLC - Baer Road Solar Farm will not have a significant adverse environmental impact. The action involves the construction of a new solar energy system (ground-mounted photovoltaic system) on 12.2 acres of land in a RU Rural District. The project is located on Baer Road in the Town of Delaware, New York.
