Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit No. NY0036315 pursuant to 6 NYCRR Part 750-1.18 and 750-1.19, the priority ranking system known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Village of Sherman Wastewater Treatment Plant has a design flow of 0.14 million gallons per day (MGD) and discharges treated sanitary wastewater into French Creek, a class C waterbody. Treatment includes a comminutor, activated sludge (extended aeration mode in summer and contact stabilization mode in winter), secondary clarification, disinfection, and post-aeration.

The proposed modifications to this permit include: the revision of Outfall 001 coordinates to more accurately reflect its location on French Creek; the reduction of the Total Residual Chlorine effluent limit (Daily Maximum) to meet the current ambient water quality standard; the alteration of the pH effluent limit range from 6.0-9.0 SU to 6.5-8.5 SU to reflect the limited dilution capacity of the receiving stream; the alteration of the CBOD5 limit to a BOD5 limit; the addition of an 85% removal requirement for BOD5 and Total Suspended Solids; and the updating of general permit conditions.

The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. A draft permit is available for review.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has made a tentative determination to approve an application for the installation of docks and boat lifts to accommodate a maximum total of twenty boats. The dock structure will be constructed of pressure treated lumber in various lengths of eight feet to twelve feet and two feet to four feet in width. The legs of the dock sections will rest on the bottom of the lake bed. The project is located on Silver Lake in the Town of Castile. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.
