Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0000078), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The facility discharges treated wastewater via Outfalls 005, 008, 010, 011, 012, 017, 018 (with 3 separate contributing flows depicted as 018A, 018B, and 018C), and 019, to Red Creek, a Class C water. Outfall 011 discharges treated sanitary and process wastewater, boiler blowdown, non-contact cooling water, and stormwater. Treatment at this outfall consists of an activated sludge process, extended aeration and clarification, and also includes a pre-treatment solvent recovery system prior to entering the treatment facility.

The following changes to the permit are proposed: For all outfalls, wastewater descriptions have been updated; specific parameter limits, monitoring, and reporting requirements have been added and/or removed; Outfall 013 has been removed; Outfall 018 has been divided into 3 separate outfalls - 018A, 018B, and 018C; Whole Effluent Toxicity Testing has been added for Outfall 008 and 011 with footnotes and compliance period limits; Outfall 019 has been added as well as parameter limits and monitoring, and special conditions for a priority pollutant scan; A compliance schedule has been added for Outfalls 011 and 019; A compliance schedule for a short term high intensity monitoring plan for Outfall 019 has been added; The water treatment chemical authorization page has been removed; The monitoring location map and flow diagram has been updated; The permit includes updated forms and the latest general conditions. Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Comments on this project must be submitted in writing to the Contact Person no later than Mar 24, 2017.
