Project Description:

The New York State Department of Environmental Conservation (DEC) has received an application for a modification of the State Pollution Discharge Elimination System (SPDES) Permit, pursuant to 6NYCRR Part 750, to decrease the design capacity of the existing Round Hill Elementary School wastewater sewage system from the currently permitted subsurface discharge of 9,900 gallons per day (gpd) to a proposed surface discharge of 4,000 gpd of treated sanitary waste water to an unmapped tributary of Satterly Creek, a Class C stream. The proposal involves replacement of the existing subsurface sand filter with a new subsurface sand filter (2 beds), two new septic tanks, dosing chamber, chlorine contact tanks, and surface discharge outlet.

DEC has made a tentative determination to modify this permit. A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 Headquarters in New Paltz. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person listed below.

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has made a tentative determination to approve this permittee initiated modification to change the technology-based effluent limit (TBEL) for total suspended solids (TSS) to a net limits for outfalls 01G and 02G. The outfalls discharge boiler seal trough water from units 1 and 2, respectively. The permit has been modified to include this modification request based on the fact that the ambient conditions of the receiving water, the Hudson River, is high in TSS (19.6 mg/L).

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 695 gallons per minute of water from an on-site irrigation pond for the purpose of golf course irrigation. The facility has been in operation since 1987. No changes in current operations from recent years are proposed.

The Department has determined that the facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
