Project Description:

RG&E AVANGRID proposes to install 3,112 Linear feet of 6-inch gas main along the north side of Walworth-Penfield Rd (CR-205), between Ontario Center Road and Orchard Street in the Town of Walworth. The installation will require crossing of an adjacent area of Freshwater Wetlands ON-41 and directional drilling beneath Red Creek, a Class C stream. The gas main will be installed by open trenching across majority of the project area, however directional drilling will be used beneath Red Creek and portions of the regulated wetland adjacent area. The Department has made a tentative determination to issue an Article 24 freshwater wetlands permit, and seeks public comments prior to making a decision.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

A SPDES modification is proposed for the industrial discharge from the City of Rochester's Hemlock Filtration Plant to Hemlock Lake (Class AA). The modification would allow an increased average discharge from 1.68 MGD to 1.95 MGD and an increase in maximum discharge from 2.24 MGD to 2.45 MGD. These increases are to accommodate higher volumes of backwash water related to increased frequency and duration of filter backwashing events. Discharge Notification Act (DNA) requirements have also been added to the draft permit. Excluding the flow value changes, no modifications have been made to discharge limits or monitoring requirements.

The Department has made a tentative determination to issue a permit for a SPDES permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval or endorsement of the activity for which a permit is sought or for the overall proposed project.
