Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal Air State Facility permit for an existing permitted facility that manufacturers elevator equipment. Raw material (metal) is fabricated, machined, degreased, finished, painted and assembled. One coating line and one degreasing line are utilized. Facility emissions are capped at 24.9 tons/yr for VOCs and HAPs, and 9.9 tons/yr for trichloroethylene (as an individual HAP). Records demonstrating compliance with these caps will be kept in accordance with the permit special conditions.

The facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

Applicant proposes to rehabilitate Battery Park wharf through pile encasements, load bearing repairs, pile section and pile cap replacements, concrete fill for scour repair, and expansion joint repair on the Hudson River between Pier A and the Brooklyn-Battery West Tunnel, Manhattan. Mitigation for the proposed project will occur at Four Sparrows Marsh, Staten Island.

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
