Petroleum Bulk Storage Program - Notice of Rescission for Rockland County

Notice is hereby given that the New York State Department of Environmental Conservation (NYS DEC) authorization allowing Rockland County to implement a local Petroleum Bulk Storage (PBS) program pursuant to the Order from December 15, 1986 is rescinded.

NYS DEC will immediately implement the State PBS program (6 NYCRR Part 613) in Rockland County. NYS DEC will be implementing the State PBS regulatory program pursuant to 6 NYCRR Part 613 within the county starting on February 1, 2017. Every subject PBS facility in the county is required to submit a registration application with the appropriate registration fee to NYS DEC no later than March 13, 2017.

Negative Declaration

Rockland County - The Town of Haverstraw, as lead agency, has determined that the proposed Recreational Complex will not have a significant adverse environmental impact. The action involves the construction of new athletic fields (one football and four baseball), concession stand, playground and dog park. The baseball fields include three little league fields and one adult field. The proposed athletic complex will encompass approximately 25 acres of land which has been acquired from Helen Hayes Hospital by the Town. The project is located on the east side of Central Highway adjacent to Cinder Road in the Town of Haverstraw, New York.

Conditioned Negative Declaration

Westchester County - The Town of Greenburgh Zoning Board of Appeals, as lead agency, has determined that the proposed Formation Shelbourne Assisted Living will not have a significant adverse environmental impact provided specific conditions are met. There will be a 30 day public comment period commencing with the date of this notice.

The action involves a proposal for a special permit (Town Board approval - pursuant to Section 285-10A(4), site plan (Planning Board approval), Planning Board steep slope, wetland/watercourse and tree removal (Town Forestry Officer approval) permit application for a proposal consisting of the construction of a four (4) story, eighty (80) unit, 59,097 square foot assisted living facility building, with off-street parking, landscaping and related amenities. Presently, the site contains a nursery, which is proposed to be demolished. Primary access to the site is proposed from Sprain Road. The project also requires area variances from the Zoning Board of Appeals (ZBA). The property consists of approximately 165,145 square foot (3.79 acres) in the R-30 One-Family Residence District. The project is located at the intersection of Underhill Road and Sprain Road in the Town of Greenburgh, New York.

The conditions are:

  • A requirement to improve Underhill Road consistent with an Off-Site Improvements Plan was prepared by the Applicant.
  • A requirement to loop the water system in the area of the site, including the installation of a pressure regulator.
  • A requirement that a full time ("24/7") Licensed Practical Nurse (LPN) or Registered Nurse (RN) be present on-site.
