Project Description:

Project involves abandonment of a 6' wide culvert on Spencer Creek and relocation of the stream channel itself. The stream will be relocated through the creation of a new channel west of the existing channel. A new box culvert 12' wide x 7.5' high and approx. 200' in length will replace the existing 258' long culvert. In addition to the culvert work, 287 linear feet of exiting channel will be replaced by 378 linear feet of new channel. The new construction will involve the excavation of approximately 3700 cubic yards of material. Portions of the existing channel (upstream and including the existing culvert) will be filled with approx. 1290 cubic yds of material from the new excavation. The new channel from the outlet of the new culvert to its re-connection with the existing channel is expected to impact a small portion of the adjacent area of NYS Freshwater Wetland IN-7. All work will be stabilized at the completion of the project to prevent water quality impacts from stormwater runoff.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The project involves dredging 103 cubic yards of material from Fourth Lake in order to constuct a new three (3) stall boathouse and associated 300 square foot dock at lakefront property located on Thistle Point Road, Town of Webb, Herkimer County. Dimensions of the area to be dredged are 40 feet by 55 feet. The proposed boathouse and dock will be founded on 10 inch steel pilings and are therefore non-jurisdictional to Article 15 of the Environmental Conservation Law.

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
