Project Description:

The expansion and upgrade of the US Land Port of Entry located at the northern terminus of Interstate Route 81. The existing facilities will be expanded and relocated approximately 800 feet to the south. Around .36 acres of New York State Regulated Adjacent Area to Freshwater Wetland F-2 will be disturbed due to road upgrading activities.

State Environmental Quality Review (SEQR) Determination:

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The activity is being reviewed in accordance with federal historic preservation laws (Section 106 of NHPA) and the project area of potential impact is substantially the same.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Feb 02, 2017.

Marcy, Oneida County

Project Description:

The project involves both rehabilitation and day lighting of an existing 72 inch by 810 inch culvert that carries New York State Route 12 over Realls Creek in the Town of Marcy, Oneida County. The total length of the existing culvert is 810 feet. Rehabilitation to 700 feet of the existing culvert will occur by placing six (6) inches of shotcrete along the inside surface of the pipe. The remaining 110 feet of culvert will be removed and the stream will flow through a stone lined channel. Impact values associated with the project include: 363 cubic yards of fill placed below the ordinary high water mark; 0.03 acre of disturbance to federally protected wetlands; and 0.04 acre of impact to waters of the United States (WOUS).

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
