Project Description:

Globalfoundries East Fishkill facility is engaged in the development and manufacturing of semiconductors for the computer and electronic industries. The emissions of Oxides of Nitrogen (NOx),Volatile Organic Compounds (VOCs), and Greenhouse Gases (CO2e (including equivalents)) are above major source thresholds as defined by the Federal Clean Air Act and therefore the facility is required to obtain a Title V permit.

Emission Unit A-00001 consists of eight (8) 72 MMBTU/hr natural gas fired boilers with low NOx burners utilizing #6 fuel oil as a backup. All tanks at the facility are exempt from 6 NYCRR 229 requirements pursuant to 6NYCRR 229.1(f)(1) or 6 NYCRR 229.1(f)(4) (horizontal petroleum or volatile organic liquid storage tanks). The vertical tanks have conservation vents and are pressurized with nitrogen to prevent emissions of volatile organic compounds to the outside atmosphere. The nitrogen pressure system is monitored periodically to ensure the system is working properly.

Emission Unit I-00001 includes the wafer fabrication that occurs in building 323 and 323A consisting of five Eisenmann Regenerative Thermal Oxidizers (RTO) used for the destruction of VOC emissions from process 0WF. All RTOs have continuous monitors and data recorders to document combustion and exhaust temperatures. The continuous monitors must be operated at all times when the associated process equipment is operating except during any quality assurance, routine maintenance or RTO system malfunction. Each monitor must be operated according to a quality assurance program approved by the Department.

In addition, Globalfoundries must demonstrate compliance with 6 NYCRR Part 212-2, Table 3 -The Degree of Air Cleaning Required for Criteria Air Contaminant and Table 4 -Degree of Air Cleaning Required for Non-Criteria Air Contaminant, for High Toxicity Air Contaminants and contaminants with environmental ratings of A, B and C. The facility performed air dispersion modeling demonstrating compliance with the maximum offsite guideline concentration for applicable contaminants, except for Hydrogen Fluoride (HF). The emission of Hydrogen Fluoride, assigned an Environmental Rating of A, is controlled by 8 Acid Scrubbers in Building 323 and 323A that are monitored continuously for PH and conductivity and must achieve a 95% emission reduction. The modeling was approved by the Department.

The facility is subject to 40 CFR 68, Accidental release requirements for hydrogen and ammonia, 40 CFR 63 Subpart WWWWWW-National Emission Standards for Hazardous Air Pollutants: Area Source Standards for Plating and Polishing Operations, and 40 CFR 98 Mandatory Greenhouse Gas Reporting. All sources of perfluorinated gases (F-gases) are equipped with point-of-use (POU) abatement. These POU abatement devices are maintained and operated per manufacturer specifications to destroy F-gases.

In accordance with 6NYCRR Parts 621.7(d)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The applicant proposes a proposed discharge with a maximum daily flow of 0.175 million gallons per day of treated process wastewater to Moodna Creek, a Class C waterbody, from a water treatment plant located at Moodna Well Field/ Butterhill Well Field. The water treatment plant facility takes ground water, treats the water to NYS Department of Health standards for potable water and distributes to customers. Water treatment includes removal of manganese via oxidation filtration. Manganese particles are backwashed. This facility has a one outfall for the filter backwash which is dechlorinated and filtered before discharge. Sodium Hypochlorite, Sodium Bisulfite and Phosphoric Acid are used in the treatment process.

DEC has made a tentative determination to issue this permit. A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 Headquarters in New Paltz. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person listed below. Project Description:

The New York State Department of Environmental Conservation (DEC) has received an application for a new State Pollution Discharge Elimination System (SPDES) Permit, pursuant to 6NYCRR Part 750, for a subsurface discharge totaling up to 43, 890 gallons per day of treated sanitary waste from fifteen (15) outfalls discharging into separate community septic tanks and leach bed treatment systems. These community sewage systems will serve the proposed Ohioville Acres Subdivision consisting of 133 single family 3 bedroom residential units with each community sewage system serving between 3 and 20 residences. The proposed community sewage system will be operated and maintained by a sewer works corporation formed by the subdivision's project sponsor.

The method of wastewater treatment described above differs from the previously approved plan to serve 135 residential lots and 1 commercial lot with individual septic systems. The previous development plan was the subject of a SEQR review in which the Town Board of the Town of Gardiner served as lead agency in which the drafting of an Environmental Impact Statement (EIS) was required (accepted as final on October 9, 2007).

In addition to the SPDES permit described above, the proposed project requires the NYS DEC to issue new permits for the following:

  • Water Withdrawal Permit (WWP) - The Department previously issued a Water Supply Permit (DEC No. 3-5124-00186/00002; Effective Date: 11/15/2010; Expiration Date: 11/14/2013) to Ohioville Acres Inc. for three wells with the combined capacity of 194,000 gallons per day that will supply water to the development with a maximum daily taking allowance of 93,760 gallons per day. Since the water supply permit has expired, a new WWP will need to be issued pursuant to 6 NYCRR Part 601: Water Withdrawal Permitting (Exclusive of Long Island Wells regulated under Part 602).
  • Stream Disturbance Permit (SD) - The Department previously issued a Stream Disturbance Permit (DEC No. 3-5124-00186/00003; Effective Date: 11/15/2010; Expiration Date: 11/14/2013) to Ohioville Acres Inc. to construct an access road, crossing Platte Kill Creek [Water Index No. H-139-13-16, Class B(T)], that will provide ingress/egress to the development from NYS Route 32. Since the SD permit has expired, a new permit will need to be issued referencing revised plans depicting the proposed central community sewage disposal systems.
  • 401 Water Quality Certifications (WQC) - The Department previously issued Water Quality Certification (DEC No. 3-5124-00186/00004; Effective Date: 11/15/2010; Expiration Date: 11/14/2013) to Ohioville Acres Inc. to disturb approximately 0.98 acres of federal wetlands. Since WQC has expired, a new WQC will need to be obtained from the Department.

Section 401 - Clean Water Act Water Quality Certification

Project is Located:

Mount Pleasant, Westchester County

Project Description:

The applicant proposed excavation of approximately 7,500 cubic yards within the Hudson River associated with the restoration of historic depths in the existing boat basin. Sediments will be pumped via a temporary pipe system to the Former GM East Parcel where it will be dewatered and used under a Beneficial Use Determination for remediation under the Brownfields Cleanup Program.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jan 26, 2017.
