Project Description:

The Albany Port District Commission proposes to reconstruct 840 linear foot (LF) of wharf, install a roll-on roll-off ramp (RoRo ramp), construct a 45,000 square foot (SF) warehouse, demolish and rebuild a 58,000 SF dock warehouse, reconstruct portions of a roadway and improve safety/security entrance features. This proposed project is located at the Cargill Grain Lease site at 400 Smith Blvd.

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant is proposing to modify an existing mining plan/permit by increasing the Life of Mine area by 0.76 acres in the northeast corner of the property, resulting in a revised total Life of Mine area of 15.67 acres. The applicant also proposes to relocate two retention basins 150 feet to the southeast, to the northcentral part of the mine, and reinstate use of a portable dry screener in processing. Lastly, the applicant proposes to add southern Saratoga and Albany Counties as communities from which yard waste can be imported to the registered composting facility within the Life of Mine area. Currently, yard waste is accepted only from Columbia and Rensselaer Counties at the facility.

Project Description:

The applicant requests a modification to combine two existing State Pollutant Discharge Elimination System (SPDES) Permits to discharge: sanitary wastewater into groundwater; and storm water runoff, hydrostatic test water, and treated garage drain water to Mud Creek, a Class C waterbody and Dead Creek, a Class C waterbody; from eleven outfall locations at the applicant's facility located at 58 Riverside Avenue, Rensselaer, New York. Previously issued SPDES permit numbers 0028843 and 0007722 shall be combined into a single permit. No permit limits are affected due to this modification.

The Department has made a tentative determination to issue a permit for a SPDES permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval or endorsement of the activity for which a permit is sought or for the overall proposed project.
