Project Description:

The applicant proposes to modify their existing Mined Land Reclamation permit (DEC No. 3-3920-00090/00003) to increase the life of mine (LOM) area by 1.8 acres (increase from 230.2 acres to 232 acres) to construct an improved crossing of South Mountain Road (County Route 90) to allow haul trucks to safely cross the roadway and access lands in the northern LOM area (NW of current active quarry operations). In addition to expanding the LOM area to a total of 232 acres, the proposed modification would: expand the excavation area within the currently permitted LOM boundary by 3.02 acres (SW perimeter of quarry near Scratchup Road); reconfigure proposed excavation benches within the quarry; and allow backfilling of a two acre area (SE corner of quarry) with overburden materials (sandstone, production screenings and fines). Although no change is proposed to the currently approved reclamation plan for the site, additional detail regarding proposed final reclamation (creation of two lakes) was provided in the application. All current quarry operations will continue as currently approved; no new processing is proposed at the site. No new equipment (other than new dust suppression system for crushing operations and new sweeper truck), is proposed. Although main quarry operations and offices are located in the Village of Haverstraw, the permittee also controls lands situated in the Town of Clarkstown. No lands within the Town of Clarkstown are affected under the proposed modification. The Haverstraw Quarry is located on Riverside Avenue, north of the intersection of NYS Routes 9W and 304, in the Village of Haverstraw and the Town of Clarkstown, Rockland County.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Comments on this project must be submitted in writing to the Contact Person no later than Feb 03, 2017.
