Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY0026042) for the surface discharge of up to 13 mgd of treated wastewater via Outfall 001 to Cayadutta Creek, a class C water.

The sewage collection system consists of separate sewers. The current treatment consists of screening, grit removal, primary settling, extended aeration, final clarification, and anaerobic digestion. Sludge is digested anaerobically, belt pressed, and landfilled at the Fulton County Solid Waste Facility. The facility accepts and treats wash water from two adjacent dairy processing facilities using a Dissolved Air Floatation Thickener (DAFT). Construction on a Contact Adsorption Settling Technology (CAST) system began to accommodate higher flows and BOD5 loadings. The system utilizes waste activated sludge from the existing aeration process to adsorb the increased organic waste load. When the CAST system is fully operational, the DAFT system will be kept in reserve. Daily processing wastewater sludge will then be combined with the municipal wastewater sludge before being sent to gravity belt thickeners and anaerobic digesters. Whey is introduced to the sludge before entering the digesters. Biogas from the digesters is used to power the facility. Outfall 003 is a sanitary sewer overflow. No treatment is provided at this outfall.This outfall is no longer listed in this permit.

DEC proposes to incorporate the following modifications to this permit: In-stream monitoring requirements have been modified. Parameter limits have been removed. Addition of concentration limits for most parameters that previously only had mass limits. Removal of limits for thallium, Aldrin, BHC, and total phenolics. Addition of total unchlorinated phenols limits. Addition of Mercury limits and a Mercury Minimization plan. Addition of seasonal disinfection requirements, limits for fecal coliform and for total residual chlorine. A Schedule of Compliance for fecal coliform and total residual chlorine has been added. The permit includes the latest general conditions. Details of changes are specified in the draft permit and fact sheet.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 325 gallons per minute of water from an irrigation pond and on-site groundwater wells for golf course irrigation. The facility has been in operation since 1963. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
