The applicant proposes to install a solar panel array and access road that would impact NYSDEC regulated wetland ED-64 and its 100' adjacent area. As proposed, the project would impact 2 acres of the regulated adjacent area, disturb 0.03 acres of the regulated wetland, and restore 0.05 acres of wetland. The project is located in the rear of the property adjacent to the high school grounds at 5572 NYS RTE 11, Ellenburg.

Project Description:

The Department (DEC) has prepared a draft permit and has made a tentative determination to approve the application that renews the existing Air Title V Permit for the pulp and paper mill. The renewal incorporates changes to the facility's nitrogen oxides reasonably available control technology (NOx RACT) requirements as required in 6 NYCRR 227-2. NOx emissions react with volatile organic compounds in the atmosphere to create ozone which can be a health hazard. This reaction typically happens during warm weather, and the "ozone season" under 6NYCRR Subpart 227-2 is May through September.

The NOx RACT plan, submitted in September 2016, retains the existing power boiler emission limits of 0.23 pounds of NOx emissions per million Btu (on a daily average basis during the ozone season and on a monthly average basis during the non-ozone season). It imposes an additional lower limit of 0.22 pounds of NOx emissions per Btu on a monthly average basis during the ozone season.

The renewal also incorporates requirements of 40 CFR 63 Subpart DDDDD (National Emissions Standards for Hazardous Air Pollutants for Major Sources: Industrial, institutional and Commercial Boilers). This includes limits on the power boiler's emissions of carbon monoxide, mercury, hydrogen chloride and particulate matter. These requirements become effective on January 31, 2017. The renewal is otherwise basically unchanged from the current permit which was last modified in January 2016.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the Air Title V Facility. The renewal application also includes a new annual limit on formaldehyde emissions and updates compliance requirements in accordance with the revised 6 NYCRR Part 212 for General Processes. In addition, the annual emission limitation on 1,3-dichloro-2-propanol was removed from the permit, since the Potential to Emit (PTE) has been reduce significantly below the limit.

The facility is re-designated as an Area source for Hazardous Air Pollutants (HAPs). This was accomplished through process changes which have lowered the facility's Potential to Emit (HAPs) below major source thresholds.
