Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0149411), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Town of Highlands Sewer Improvement Area facility has surface discharge of 0.120 mgd of treated wastewater to the Hudson River, a class B water. Treatment consists of screening, grit removal, extended aeration, disinfection, sludge stabilization and sludge dewatering.

The following changes to the permit are proposed: Permit pages and conditions have been updated, renumbered and reordered, and reflect current permit language, DEC guidance, format and nomenclature. Latitude and longitude of Outfall 001 has been updated. Sample type for flow has be updated to a recorder. Influent sampling for specific parameters has been removed. Monitor only sampling requirement has been added for Ammonia. An interim limit is in effect for Total Residual Chlorine until the disinfection system is upgraded to meet the final limit in accordance with the Schedule of Compliance. A Mercury Minimization Program has been added. A monitoring location page has been added.

The applicant has applied for an initial permit for the continued withdrawal of 1269 gallons per minute of water from on-site wells for the purpose of golf course irrigation and potable water uses. The facility has been in operation since 1964. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The Department has made a tentative determination to approve this application for modification to an existing SPDES permit # NY 002 4538 to increase the permitted discharge from 0.7 million gallons per day to 1.0 million gallons per day. Changes are proposed to effluent limits based on current standards and the increase in flow, including reduction in the total residual chlorine limit, implementation of Whole Effluent Toxicity (WET) testing, additional stormwater controls and monitoring, a mercury limit and mercury minimization requirements, and increased sampling frequencies. The discharge will continue to be into Evans Lake, NYS WIN D-1-38-P50a, Class B.

The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits. A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz.

Project Description:

The applicant proposes to remediate Paterno Dam, located on the regulated waterbody, "Tribs of Mianus River", Waters Index No. CT-4-17-P1108P, Class AAS, in the Town of North Castle, Westchester County. The remediation project includes work on the dam crest, the outlet structure and the stabilization of the discharge pipe which discharges into the existing stream channel. Construction also includes the installation of a new inlet box with drain-down valve for the control of the pond water elevation. Access to the dam site is proposed across an existing grassed area on Windmill Road, on the north east side of the Lake. A coffer dam will be installed for work within the lake. Bank stabilization plantings will be conducted once the dam remediation is complete, including approximately 310 linear feet of pond buffer plantings. The total area of disturbance is 0.74 acres, and the disturbance area within the waterbody is 0.13 acres (5663 SF).
