Notice of Revised Rulemaking

6 NYCRR Part 490, Projected Sea-level Rise

Pursuant to Section 3-0319 of the Environmental Conservation Law (ECL), the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

NYS DEC is proposing substantial revisions to the proposed new 6 NYCRR Part 490, Projected Sea-level Rise (Part 490) in response to public comments received on the initial notice of proposed rulemaking for Part 490. Part 490 will establish projections of sea-level rise in three specified geographic regions of New York State over various time intervals.

The Community Risk and Resiliency Act (Chapter 355 of the Laws of 2014) added Section 3-0319 to the ECL. Section 3-0319 requires NYS DEC to adopt regulations establishing science-based State sea-level rise projections. The promulgation of Part 490 by NYS DEC will fulfill this statutory requirement.

Written comments: The public is invited to submit written comments on the revised proposed Part 490 through December 30, 2016. Written comments can be submitted as follows:
