Project Description:

New York State Department of Environmental Conservation has made a tentative determination to issue a permittee initiated modification of a State Pollutant Discharge Elimination System (SPDES) permit under Article 17 of the Environmental Conservation Law. The permit will also be renewed as part of this modification. The application is for the discharge of a varying amount of treated quarry dewatering wastewater and stormwater runoff through outfall 001 to Miller Creek Tributary, a Class C waterbody, and through outfall 002 to Philomel Creek Tributary, a Class C waterbody from the applicant's facility located in the Town of Pamelia, Jefferson County, New York.

The following changes to the permit are proposed: Outfall 001 was relocated due to expanded mining operations; existing outfall 002 was corrected to discharging to Philomel Creek Tributary; effluent limitations and monitoring requirements have been revised; Best Management Practices (BMPs) requirements have been added; facility contact information has been updated; permit pages have been revised to incorporate current format, content, nomenclature, and general conditions

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has received a request for a Renewal #3 of a Title V Air Permit for the purpose of operating air pollution sources and has drafted, pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, a Title V Renewal #3, for the facility which is located at Varflex Corporation, in the City of Rome, in Oneida County, in the State of New York. The exact location is 512 West Court Street. This facility is engaged in the manufacture of electrical insulating sleeving for the electronics industry. The Standard Industrial Classification representative of this facility is 3644 (Noncurrent Carrying Wiring Devices) and 3699 (Electrical Equipment & Supply). The main source of air emissions originates from web-fabric surface coating operations. With respect to air pollution regulation, the emissions of concern at Varflex are VOC, HAP and particulate matter. The facility has elected to cap VOC emissions below the Major Source Threshold. Varflex is subject to 40 CFR 63-Subpart OOOO due to web-fabric coating at a major source. This facility operates an air pollution control device (thermal oxidizer) as required by 6 NYCRR 228 and the MACT citation.

States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 930 gallons per minute of water from an the St. Lawrence River for cooling purposes. The facility has been in operation in its current configuration since 1993. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
