Project Description:

Arkwright Summit Wind Farm LLC (the Applicant) is proposing to construct a wind energy generation facility in the Towns of Arkwright and Pomfret in Chautauqua County, New York. The Project will consist of 36 turbines for a total anticipated nameplate generating capacity of 78.4 MW. The Project will also include construction and operation of a single permanent meteorological tower, a system of gravel access roads, electrical collection and communication cables, a generator lead line, an operations and maintenance facility, a point-of-interconnect substation, and a collection substation. Construction of the Project will also require a temporary construction staging area to store Project components (laydown yard), accommodate construction trailers, and provide parking for construction vehicles. The proposed Project is located on approximately 3,883 acres of leased private land, or land that is currently under negotiation to lease. The wetland take permit is for the proposed wetlands designated as FO-13 and DU-17. Impacts to these two wetlands will total 1.41 acres of permanent fill, 1.98 acres of temporary disturbance, and 5.04 acres of permanent forest conversion. Impacts to the one hundred foot upland buffers of these wetlands will total 12.3 acres of permanent fill, 1.91 acres of temporary disturbance, and 17.37 acres of permanent forest conversion.

Impacts to Wetland FO-13 include 1.33 acres of permanent fill, 1.98 acres of temporary disturbance, and 3.93 acres of permanent forest conversion. Impacts to the Wetland FO-13 one hundred foot upland buffer include 12.06 acres of permanent fill, 1.01 acres of temporary disturbance, and 16.65 acres of permanent forest conversion. Impacts to Wetland DU-17 include 0.08 acres of permanent fill, no temporary disturbance, and 1.11 acres of permanent forest conversion. Impacts to the Wetland DU-17 one hundred foot upland buffer include 0.24 acres of permanent fill, 0.9 acres of temporary disturbance, and 0.72 acres of permanent forest conversion.

The Article 15 stream disturbance permit is for 499 feet of total stream bank permanent impact and 30 feet of total stream bank temporary impact to Clinton Brook (Class C(t)), Unnamed Tributary of Walnut Creek (Class C(t)), Perennial Tributary of S-T03-014 (Class C(t)), Unnamed Tributary of Canadaway Creek (Class B). A 401 Water Quality Certificate is requested due to impacts on Army Corps of Engineers regulated wetlands via federal law.

State Environmental Quality Review (SEQR) Determination:

A final environmental impact statement has been prepared on this project and is on file.

SEQR Lead Agency: Arkwright Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an adverse impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
