Project Description:

Duck's Unlimited wetland enhancement project on 100 acres of privately owned land located on the west side of Alexander Rd, north of the intersection with Rose Rd, in the Town of Batavia. The goal of this project is to enhance areas of low quality emergent marsh (located within NYS freshwater wetland BS-7) by: 1) replacement of a failing water control structure, 2) construction of four new 18-inch high earth berms to increase impoundment capacity and 3) excavation of new open water channels and potholes within areas of dense cattail vegetation.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Town of Wayland is requesting to add 3.64 acres to the currently approved 24.50 acre Life of Mine Area at the Johnson Gravel Pit, which is located on the north side of Emo Rd, approximately 1500 feet west of County Route 92. With this application, the Town is also requesting use of a portable crusher to process aggregate. Currently, screening is the only approved method of processing extracted minerals. There are no changes in hours of operation, rates of truck traffic, methods of extraction or reclamation being proposed.
