Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 1,520 gallons per minute of water from an on-site pond and groundwater wells for the purpose of aggregate production and potable water supply. The facility has been in operation since at least 1989. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The applicant proposes to develop and operate a 46.2 acre topsoil mine within a 59.34 acre parcel approximately one mile south of Central Square on the northeast corner of the intersection of US Route 11 and Corporate Park Drive. The project site is the applicant's property. The mine is intended to operate as a traditional topsoil mine. Mining is not proposed for below the local water table. Excavation will be done by bulldozer or hydraulic excavator. Loading of trucks will be accomplished by a front-end loader or hydraulic excavator. Mining is proposed to remove approximately 75,000 cubic yards of topsoil over the estimated 10 year operational life of the mine. The topsoil on site contains a high percentage of clay therefore sand from offsite will be imported and blended to produce a higher quality product. A portable screening plant equipped with a shredder will be used to blend the soil and sand. Material will be stockpiled. No processing will occur within 1,000 feet of the residences along US Route 11. Maximum processing rates for the screening will not exceed 150 tons-per-hour (TPH). Final reclamation will restore the site to a condition consistent with local land use and will be revegetated and suitable for open space. The reviewed Life-Of-Mine (LOM) area is 46.2 acres.

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
