Project Description:

The applicant proposes to develop a new 33 acre sand and gravel mine on an 82+ acre parcel and remove 750,000 cubic yards (yd3) of material in seven (7) phases. To process mined materials, the proposal includes new portable diesel powered crushing and dry screening equipment registered as NYS emissions sources (Air Facility Registration Certificate #3-1320-00012/00005). Proposed excavation will not intercept groundwater elevations as mining progresses. No discharge of stormwater from active mine areas is proposed. Topsoil will be stripped and stockpiled for use in reclamation and will be stored onsite as screening berms along the perimeter of the active mining area. Reclamation will proceed concurrently with mining operations and proposed final reclamation would create gently sloping open fields. A prior application for MLR permit (DEC No. 3-1320-00012/00003) was withdrawn at the request of the applicant December 3, 2012. The project is located on the northwest side of South Amenia Road, opposite Clark Hill Road, in the Town of Amenia, Dutchess County.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes disturbance to New York State Freshwater Wetland F-21, Class 2, associated with the construction of a single family dwelling, driveway, well, septic system and infiltration system. The area of disturbance is approximately 7,530 SF within the 100 foot adjacent area of Freshwater Wetland F-21. This proposed action is within the Town of Somers, Westchester County.

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
