Project Description:

The Department has received and made a tentative determination to approve an application for the construction of a 14 space parking lot alongside of Sweet Home Road to service the southern portion of Nature View Park. The project will disturb 2,600 sq. ft within the adjacent area of NYS Regulated Wetland TE-17.

As a tentative determination the Department is seeking public comments prior to making a final decision on permit issuance.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Amherst Town Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0002399), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). The facility has a treated surface discharge of non-contact cooling water, boiler blowdown and stormwater via Outfalls 001, 002, and 004 to the Niagara River, a class A-Special water. Discharge from the cogeneration plant was the sole source of wastewater from Outfall 003 until it ceased operation in 11/2009.

The following changes to the permit are proposed: Outfall 001 - Limits, monitoring, and action levels for parameters have been adjusted or added. A short term high intensity monitoring program for Benzo(a)pyrene has been added, and the Action Level has been removed. Monthly average limits for total suspended solids, oil and grease and settleable solids have been removed. Best Professional Judgment action level for iron has been added. Monitoring frequency for temperature has been increased to continuous. Outfall 002 - Report flows have been changed. Whole Effluent Toxicity Testing has been added. Short term high intensity monitoring program for pollutants has been added. Outfall 003 - Schedule of Submittals added for a priority pollutant scan two months after recommencement of the outfall. Biological monitoring requirements added for the cooling water intake. The permit includes updated forms and the latest general conditions. State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
