Project Description:

Duck's Unlimited wetland enhancement project on 100 acres of privately land owned located on the west side of Alexander Rd, north of the intersection with Rose Rd, in the Town of Batavia. The goal of this project is to enhance areas of low quality emergent marsh (located within NYS freshwater wetland BS-7) by: 1) replacement of a failing water control structure, 2) construction of four new 18-inch high earth berms and 3) excavation of new channels as potholes within currently dense stands of cattail.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 900 gallons per minute of water from an on-site pond and groundwater well for the purpose of golf course irrigation. The facility has been in operation since at least 2011. No changes in current operations from recent years are proposed.

The Department has determined that the facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The applicant has applied for a water withdrawal permit for the proposed withdrawal of 1 million gallons per day from a groundwater well system with a capacity of 1.005 MGD of water for use in non-contact cooling needed for the operation of the Fleishmann's Vinegar Company. The Facility, which has been in operation using potable water and one well, proposes to increase production and non-contact cooling water needs, and to change to using primarily onsite well water, from three wells, for the majority of non-contact cooling water in lieu of potable water. The Department has determined that the Facility is not eligible for an Initial Permit under Section 15-501.9 of the Environmental Conservation Law because the facility was only pumping from one of the three wells proposed for use. As a tentative determination, the Department seeks comments prior to making a final decision.
