Project Description:

The Department has received and made a tentative determination to approve an application for a bulkhead replacement and dredging project on Skaneateles Lake, at The Glen Haven located at 7434 Fair Haven Rd in the Town of Scott. Applicant proposes removal and replacement of bulkhead using pile driven, vinyl sheet pile along 265 feet with approximately 20 linear feet of impact to the 100 foot adjacent area of NYS Freshwater Wetland SP-3, Class 1. The dredging project proposes the isolation of the marina using a reinforced turbidity curtain, and the dredging of approximately 3700 cubic yards of accumulated sediment. Dredged material will be de-watered on-site using the parking lot adjacent to the dredge location, and removed off-site to a Department approved facility. Silt fence, straw bales, and turbidity curtains will be utilized to protect water quality of the Lake while the project is undertaken.

Applicant proposes to perform a shoreline beach replenishment project on Oneida Lake along ten adjacent properties starting from the north end at 9603 Lewis Point Rd moving to the south end at 9447 Lewis Point Rd, in the Town of Lenox. The project will consist of dredging, with a wheeled loader and bucket, approximately 3000 cu yards of naturally deposited sand just offshore. The sand will then be evenly placed along the ten shorelines that have eroded.

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 024 4872) of the Tessy Plastic Corporation facility pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The most significant prosed changes to the permit are as follows: Non-contact cooling water and mop water discharges have been eliminated from Outfall 001; and, the limit on the sanitary wastewater discharged though Outfall 005, for both Total Suspended Solids and BOD, is now 30/45 mg/L as a monthly average/7 day average.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 950 gallons per minute of water from an on-site pond for aggregate production. The facility has been in operation since 1987. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
