Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0004880), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification will also serve to renew the SPDES permit, the term of which was extended under the State Administrative Procedures Act (SAPA). This is a re-notice updating the Notice of Intent to Modify published in the Environmental Notice Bulletin on 01/20/2016.

Norlite is an aggregate manufacturer. The facility discharges treated process wastewater via Outfalls 003, 004, 006, 06A, and O6C into receiving waters known as Salt Kill Creek (H-239), a class D waterbody.

The following changes to the permit are proposed: New parameter limits have been added for Outfalls 003, 004, 006, 06A and 06C. New parameter monitoring requirements have been added for Outfalls 004, 006, and 06C. The addition of Whole Effluent Toxicity testing action levels have been added for Outfalls 004 and 006. Designation of a new sampling point for Outfall 006C has been added. Sampling requirements for specific parameters for Outfall 004 have been removed. Outfalls 06B, 007 and 008 are no longer in use and have been removed. The permit includes updated forms and the latest general conditions. State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to install a new driveway that crosses the 100-foot adjacent area of state-protected freshwater wetland CL-14. A roadside ditch that runs on the south side of County Route 6 will be crossed by installing a 12-inch diameter, flared-end culvert pipe with a 24-foot-wide apron that is 24 feet long. Construction of the driveway will result in no more than 5,000 square feet of wetland adjacent area disturbance.
