Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility (ASF) permit for an existing permitted Air Title V (ATV) facility, the Newtown Creek Wastewater Treatment Plant (WWTP). The Title V permit (DEC ID# 2-6101-00025/00057) will be relinquished and discontinued upon ASF issuance. The facility is a 310 million gallon per day (MGD) publicly owned secondary WWTP using purchased electricity. This application is being submitted to downgrade the current ATV to an ASF Permit by capping the facility-wide NOx emissions to 24.9 T/yr.

The WWTP process includes wastewater treatment and an odor control system. This WWTP also includes: nine (9) 29.5 mmBtu/hr Cleaver-Brooks boilers firing digester gas and/or natural gas blend, three (3) 16.75 mmBtu/hr Cleaver-Brooks boilers firing natural gas, four (4) 46 mmBtu/hr Varec 249 enclosed waste gas flares to burn excessive sludge digester gas, four (4) 58 mmBtu/hr 5MW Solar Taurus 70 5MW emergency turbine diesel generators (operated less than 500 hrs/yr), and may participate in any load sharing CDRP/PLM program, two (2) 7.5 mmBtu/hr Cummins QST30-G1 black-start diesel engine generators, and one (1) 7 mmBtu/hr thermal oxidizer to destroy those impurities removed from separation of the plant's digester gas.

The facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has made a tentative determination to approve a renewal application for an existing facility which produces and supplies concrete, asphalt and aggregate to the construction industry. The applicant proposes to modify the existing Air State Facility permit to add one 795 kW diesel engine generator, in addition to using one 1500 kW diesel engine as main source engine. The 400 kW diesel engine generator will now operate as an emergency generator only (operated no more than 500 hrs/yr). The asphalt production rate is 200 Tons/hr, and annual production limit is 350,000 Tons/yr. The annual facility nitrogen oxides (NOx) emissions are limited to 24.9 Tons/yr.

The facility is subject to the provisions of State Facility specified under 6NYCRR Part 201-7.2. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised.
