Negative Declaration

Nassau County - The Incorporated Village of Old Westbury Board of Trustees, as lead agency, has determined that the proposed Queen of Peace Cemetery will not have a significant adverse environmental impact. The action involves an amendment of a previous approval which included: (a) Special Exception Permit for a place of worship/cemetery on 70.6 ± acres; and (b) nine lot residential subdivision on 26.7 ± acres. The primary elements of the Proposed Action as amended include: (1) elimination of the nine lot residential subdivision; (2) amendment of the Special Exception Permit for an expanded place of worship/cemetery on 87.6 ± acres; (3) deletion of a 9.7 acre parcel from the subject application, with no action currently being considered for this parcel; (4) redesign of the stormwater management system for the proposed development to provide for drainage reserve areas (DRAs), in place of an extensive system of leaching pools under the previously approved project, while retaining the same (eight-inch) storage capacity; (5) use of material excavated from the DRAs to construct a system of perimeter berms to provide visual screening and buffering from surrounding roadways; (6) modification of the groundwater monitoring program the applicant will be required to undertake, which is at least as protective of the environment as the program formulated for the previously approved project; and (7) enhanced buffers at the northern property line, where the site adjoins existing residential development. The project is located on the north side of Jericho Turnpike, between Hitchcock Lane and Powell's Lane in the Village of Old Westbury, New York.
