Project Description:

The applicant proposes to mine sand and gravel on 16.5 acres of land out of an approximately 20.6 acre parcel owned by the applicant at this location. Mining will not intersect the water table. Mined material will be hauled to the applicant's Buffalo Road plant for processing, with some dry processing on site with a portable dry screen and/or crushing unit with a capacity of less than 150 tons per hour. The reclamation objective is wildlife habitat/open space.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Dec 02, 2016.

Project is Located:

Project Description:

The Department has received and made a tentative determination to approve an application for the construction of approximately 150 feet of rock revetment at 1609 Lake Road in the Town of Porter. The west end of the wall will be approximately 8 feet in height to cover the eroded embankment. The remainder of the wall will be 2 - 4 feet in height. Four to five ton toe stone will be embedded 1 - 2 feet deep along the shoreline, with 2 - 3 ton stone placed behind. The proposed revetment will be constructed at a 2:1 slope with geotextile fabric installed below the rock.

As a tentative determination, the Department is seeking public comments prior to making a final determination on permit issuance.
